Our General Terms and Conditions for private nude photography govern the business relationship between you as a private customer (hereinafter: model) and the MOMENTS photo studio, Marcus Thiemann, as the author.

Booking

Once an appointment has been agreed, the photo shoot is considered firmly booked.

Cancellation

A confirmed booking may only be cancelled for good cause. For the customer, good cause is limited to circumstances that could not have been foreseen or planned.
Cancellation up to 7 days before the shoot is free of charge. If cancellation takes place less than 7 days before the shoot, the studio and, where applicable, the make-up artist are entitled to a cancellation fee of 50% of the agreed fee. If cancellation takes place on the day of the shoot, after the shoot has begun, or in the event of a no-show, the cancellation fee is 100%.
If the shoot is rescheduled for a later date, half of the cancellation fee will be credited towards the shoot.

Confidentiality guarantee

All private nude and lingerie photographs created by us are treated in strict confidence and securely archived. You can find more information under Copyright & Privacy.

Copyright

Copyright in all photographs created by us remains with us. Reproduction and publication by photographic, printing, photo, video or digital means are permitted only with written authorisation.
Photographs from the MOMENTS nude photography studio may be published only with the author credit in the following form: "© Moments.Berlin - Marcus Thiemann".

Any publication fees are calculated according to the current MFM price list.
Any special arrangements must be agreed in writing.

Storage

The customer should collect the finished work as soon as possible after completion.
Negatives and digital data are archived for the customer. A backup is made of all data.
However, no liability can be accepted for data loss, regardless of the cause. Deletion of the data after the shoot may be agreed for an appropriate fee.

Warranty

Complaints about defects must be made by the customer immediately after delivery of the commissioned work. For defects that are not apparent, the statutory limitation period of six months applies.
In the event of justified complaints, the customer is entitled only to rectification or replacement, at our discretion. If rectification or replacement fails, the price may be reduced or the contract rescinded.
All further claims, in particular compensation for indirect damage, are excluded.

Shipping

Private Moments will carefully package every shipment. Shipping is carried out only at the customer’s express request and at the customer’s own risk. Separate insurance or registered delivery must be agreed separately. On request, shipping can be made without identifying the sender.

Commercial use

All content and prices on this website relate to private nude photographs. Any commercial use of private nude photographs is excluded from the outset.
Any deviation requires the model’s written consent.
If photographs were produced for advertising purposes (e.g. beauty or lingerie photographs for hotels, spas or lingerie manufacturers), or are to be used for such purposes, the Terms & Conditions of Menschen und Architekturfotografie, Marcus Thiemann (www.menarc.com), apply.

Place of performance and jurisdiction

The place of performance and jurisdiction for all disputes is Berlin.

Severability clause

If any clause of the contract is invalid, it shall be replaced by a provision that comes closest to the intended result. This shall not affect the validity of the remaining Terms & Conditions.
